1. Acceptance of Terms
By accessing or using WealthMode ("the Service"), you agree to be bound by these Terms of Service. This Agreement is between you and DaCost Software, an Ontario-registered business (BIN: 1001478139) with its principal place of business at 100 Main St E Unit 202 #3017, Hamilton, ON, Canada, L8N 3W4. If you do not agree to these terms, please do not use the Service.
2. Description and License of Service
WealthMode is a personal finance tracking application that allows you to view and organize your financial information. The Service is read-only - we can display your transaction data but cannot move money or make changes to your bank accounts.
We grant you a non-exclusive, non-transferable, limited license to access and use the Service. We retain all rights of ownership in the software. You do not acquire any ownership interest in the Service.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Share your account with others
- Decompile, reverse engineer, or attempt to derive the source code of the Service
5. Third-Party Services
WealthMode uses third-party services including Plaid (for bank connections), Stripe (for payment processing), and MailerSend (for email delivery). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the performance or availability of these third-party providers.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEALTHMODE AND DACOST SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to your data
- Any errors, inaccuracies, or omissions in transaction data
- Any third-party conduct on the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRIOR TO THE CLAIM, OR (B) TWENTY CANADIAN DOLLARS ($20 CAD).
8. No Financial Advice & Not a Fiduciary
WEALTHMODE IS A PERSONAL FINANCE TRACKING TOOL FOR INFORMATIONAL PURPOSES ONLY. WE ARE NOT A FIDUCIARY, FINANCIAL ADVISOR, OR REGISTERED INVESTMENT ADVISOR. NOTHING DISPLAYED IN THE SERVICE CONSTITUTES PERSONALIZED FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. YOU SHOULD NOT MAKE FINANCIAL DECISIONS BASED SOLELY ON INFORMATION DISPLAYED IN WEALTHMODE.
9. Data Accuracy
Transaction data is provided by third-party services (including Plaid). We do not guarantee the accuracy, completeness, or timeliness of this data. You acknowledge that bank balances, transactions, and categorizations may contain errors and should be verified against your official bank statements.
10. Subscription & Refunds
Free Tier: Access to basic features at no cost. We reserve the right to modify free tier features at any time.
Paid Subscriptions: Billed monthly or annually in advance. Subscriptions auto-renew unless cancelled.
Refund Policy:
- Cancel anytime from your account settings
- Monthly subscriptions: Refunds considered on a case-by-case basis within 7 days of charge
- Annual subscriptions: 100% refund within 7 days of charge, pro-rated refunds within 30 days

11. Termination
We may terminate or suspend your account at any time for violation of these terms. You may delete your account at any time from your account settings.
12. Dispute Resolution
Informal Resolution First: Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Class Action Waiver: You agree to resolve disputes individually. You waive any right to participate in class actions, class arbitrations, or representative actions.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
14. Service Availability & SLA
We aim for high availability but do not guarantee 100% uptime. We reserve the right to perform periodic maintenance which may cause temporary unavailability. We are not liable for any losses resulting from service interruptions, including outages of third-party infrastructure providers like AWS or Plaid.
15. Force Majeure
Neither party shall be liable for any failure to perform due to causes beyond their reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, or systemic failures of internet infrastructure.
16. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
